Legal & Privacy

These Terms of Service (“Terms”) govern your use of ColorGraph.AI, including the designer dashboard at app.colorgraph.ai and the client review pages we generate on your behalf. By creating an account or using the service, you agree to these Terms. If you do not agree, please do not use the service.

1.1 Eligibility & Your Account

You must be at least 18 years old and use ColorGraph in the course of your professional activity. You are responsible for keeping your sign-in credentials secure and for activity that happens under your account. Provide accurate account information and keep it up to date.

1.2 Subscriptions, Trials & Billing

• Merchant of record. Payments are processed by our payment partner Polar Software Inc. (polar.sh), which acts as the merchant of record. Polar handles checkout, invoicing, and applicable VAT/sales tax, and its own terms apply to the payment transaction.
• Free trial. Self-serve plans include a 3-day free trial. A payment method is required to start it. If you do not cancel before the trial ends, your subscription starts automatically and your payment method is charged.
• Auto-renewal. Subscriptions are billed in advance, monthly or annually depending on the plan you choose, and renew automatically at the end of each billing period until canceled.
• Cancellation. You can cancel anytime from Settings → Billing (via the customer portal). Cancellation takes effect at the end of the current billing period; you keep access until then. We do not prorate partial periods.
• Refunds. Except where required by law, payments are non-refundable. If something went wrong — a billing mistake, a double charge, or the service failed you — email support@colorgraph.ai and we will review refund requests case by case. Nothing in these Terms limits your statutory rights as a consumer.
• EU right of withdrawal. By starting your trial or subscription you request immediate access to a digital service; where you expressly consent to immediate performance, the statutory 14-day withdrawal right may lapse to the extent the service has been performed. Your other statutory rights are unaffected.
• Plan limits. Each plan includes defined limits (clients, active projects, and AI feedback sessions per month). If you reach a limit, you can upgrade to continue.
• Price changes. We may change prices with advance notice by email or in-app. Changes apply from your next billing period; if you disagree, cancel before the change takes effect.

1.3 Your Content & Intellectual Property

You retain all rights to the designs, brand assets, and other content you upload. You grant us a limited license to host, process, display, and transmit that content solely to operate the service — for example, showing a design to the client reviewers you invite and running AI analysis on it. You are responsible for having the rights to upload and share the content you submit. ColorGraph retains all rights to the platform, its software, and its scoring methodology. You may not reverse engineer the service or use it to build a competing dataset or product.

1.4 Client Reviewers

ColorGraph lets you share review links with your clients so they can give feedback without creating an account. You are responsible for sharing review links only with people entitled to see the design in question. Feedback your clients submit becomes part of the project record in your account.

1.5 Acceptable Use

You agree not to upload unlawful content or content that infringes someone else's rights; not to abuse, overload, probe, or disrupt the service; not to circumvent plan limits or access controls; and not to use the service to harass others or distribute malware. We may suspend or terminate accounts that violate these rules.

1.6 Third-Party Integrations

Optional integrations (such as Figma import) connect your ColorGraph account to a third-party service under that service's own terms. You can disconnect integrations at any time from Settings.

1.7 Disclaimer — AI Output Is Advisory

ColorGraph's AI analysis and scores are automated opinions intended to structure feedback, not guarantees of design quality or business outcomes. The service is provided “as is” and “as available”, without warranties of any kind to the fullest extent permitted by law. We continuously improve the service and may change or retire features.

1.8 Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for lost profits or lost data, and our total liability for any claims relating to the service is limited to the amounts you paid us in the 12 months before the claim arose. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including mandatory consumer protections.

1.9 Termination

You can stop using ColorGraph and delete your account at any time from Settings → Privacy. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the service (with reasonable notice where practicable). Sections that by their nature should survive — including intellectual property, disclaimers, and liability limits — survive termination.

1.10 Governing Law

These Terms are governed by the laws of Romania. If you are a consumer in the EU, you also keep the protection of the mandatory consumer laws of your country of residence, and you may bring proceedings in your local courts.

1.11 Changes to These Terms

We may update these Terms as the service evolves. For material changes we will notify you by email or in-app before the changes take effect. Continuing to use the service after that date means you accept the updated Terms.

This policy explains what personal data we collect, why, who processes it, and the rights you have under the EU General Data Protection Regulation (GDPR). The data controller is the operator of ColorGraph.AI, reachable at support@colorgraph.ai.

2.1 What We Collect

• Account data — name, email, role, and company details you provide at sign-up (including via Google sign-in).
• Project & client data — projects, client names and emails you add, brand profiles, deadlines, and settings.
• Design assets — the design files and URLs you upload for review.
• Feedback & conversation data — client ratings, comments, annotations, AI analysis results, and revision history.
• Billing data — your subscription plan and status. Card details are collected and stored by Polar, our payment processor; we never see your full card number.
• Technical data — IP address, browser type, and application logs (including error reports) used for security and reliability.

2.2 Why We Process It (Legal Bases)

• To provide the service (performance of contract) — accounts, projects, reviews, AI analysis, billing, and support.
• Legitimate interests — securing the platform, preventing abuse, monitoring errors, and improving the product.
• Consent — optional communications and any optional programs, which you can withdraw at any time.
• Legal obligations — tax and accounting records connected to payments (handled with Polar).

2.3 Who Processes Your Data

We use a small set of service providers (processors) to run ColorGraph. We do not sell your personal data.

• Clerk (US) — authentication and account management.
• Convex (US, on AWS infrastructure) — application database and file storage.
• OpenAI (US) — AI analysis of designs and feedback text. Per OpenAI's API terms, data sent through the API is not used to train OpenAI's models.
• Polar (US) — payment processing, as merchant of record.
• Resend (US) — transactional email delivery (review invitations, reminders, account emails).
• Amazon Web Services (US/EU) — application hosting and content delivery.
• Sentry (US) — error monitoring, so we can find and fix crashes.
• Figma (US) — only if you connect the Figma integration.
• Google Fonts (US) — this website loads fonts from Google's servers, which involves transmitting your IP address to Google.

Where providers process data outside the EU/EEA, transfers rely on the EU–US Data Privacy Framework and/or the European Commission's Standard Contractual Clauses.

2.4 Client Reviewers

When a designer invites you to review a design via a link, we process the feedback, comments, and annotations you submit in order to provide the service to that designer. Review links are secured with unique tokens. If you want feedback you submitted corrected or removed, contact the designer who invited you, or email us.

2.5 How Long We Keep It

• Your data is kept while your account is active.
• You can set an automatic project retention period (6 months, 1 year, or 2 years) in Settings → Privacy; older completed projects are then cleaned up automatically every day.
• Deleted projects go to trash and are permanently purged after 30 days.
• Data export files are automatically deleted 48 hours after generation.
• When you delete your account, your personal data and content are deleted from our active systems, with residual copies removed from backups on their normal rotation schedule.

2.6 Your Rights

Under the GDPR you have the right to access, rectify, erase, and receive a portable copy of your personal data, to restrict or object to certain processing, and to withdraw consent at any time. The fastest way to exercise the main ones is built into the product: Settings → Privacy gives you one-click data export and account deletion. For anything else, email support@colorgraph.ai. You also have the right to lodge a complaint with your data protection authority — in Romania, ANSPDCP (dataprotection.ro), or the authority in your own country of residence.

2.7 Security

All traffic to and from ColorGraph is encrypted in transit (TLS/HTTPS), and our cloud providers encrypt stored data at rest. Review links use unique, hashed tokens, and access to production systems is restricted. No system is perfectly secure — if we become aware of a breach affecting your personal data, we will notify you and the supervisory authority as required by law.

2.8 Children

ColorGraph is a professional tool and is not directed at anyone under 18. We do not knowingly collect data from minors.

ColorGraph uses essential cookies only — the cookies our authentication provider (Clerk) needs to keep you signed in securely and protect your session. These are strictly necessary for the service to work, which is why you don't see a cookie consent banner.

We do not use advertising cookies, and we do not run third-party analytics trackers on this website or in the app. If that ever changes, we will update this policy and ask for your consent where the law requires it.
